Terms and Conditions
Your agreement with us is made up of:
. these terms and conditions which cover the trial of the service and
. the attached service schedule
Important Information
You will not be able to use the service to make 999/911/112 emergency calls. If possible, you should make alternative arrangements and keep a main phone line available.
The service we provide
1. The service you agree to trial for us is described in service schedule.
2. The service is for home use only and not for business
Where we provide service
3. We will provide the service to the telephone number that you have registered with us on the BT AvaTalk webpage.
What you need
4. In order for us to provide the service you will need to ensure that:
- you meet the criteria for participation as described in service schedule;
- you have disabled any incompatible product or service as described in service schedule; and
- you maintain any other specified existing services as described in service schedule.
When does your agreement with us start and finish?
5. Your agreement will begin on the day that we accept your registration for the service.
6. Your agreement will end on the date we specify in the service schedule, unless we end it earlier.
Getting started
7. You will need to have a personal computer capable of running the Second Life client, an internet connection and a phone line that can receive incoming calls and you agree to follow any reasonable instructions including security instructions that we may give you about the service.
Quality of the service
8. You accept that the service is being developed. We do not guarantee that the service will be free from faults. You agree to report any faults to us promptly. We will try to repair any faults you report within a reasonable timescale.
9. For operational reasons we may suspend the service or vary the technical specification of the service. We will try to tell you before we do this.
Paying for the service
10. Your use of the service will be free of charge during the trial and is subject to the limitations as to usage set out in the service schedule.
Ending the agreement
11. If you wish, you may end this agreement at any time.
12. We can end this agreement at any time without notice. We may also end this agreement if you break the terms of this agreement.
Using the service
13. You must not use the service or allow the service to be used:
- to make offensive, indecent, menacing, nuisance or hoax calls; or
- fraudulently or in connection with a criminal offence.
You agree to take all reasonable steps to make sure that this does not happen.
We take this kind of misuse very seriously. If we reasonably believe it has happened, we may take immediate action to suspend the service or end the agreement, without telling you first, even if you were not aware of the misuse.
14. If we make software available to you, you agree:
- that it is for your use only, and not to transfer it to anyone else, or to try to do so;
- not to copy or modify it (unless you are allowed by law to do so); and
- to use it only as we instruct.
15. You agree not to connect equipment to the network over which the service is provided that may harm the network or other customers' equipment. If you do, you must disconnect it immediately, or allow us to do so at your expense.
16. You accept that this agreement is personal to you and you agree not to transfer it to anyone else, or to try to do so.
Security
17. You are responsible for the security and proper use of any user IDs and passwords and must take all necessary steps to ensure that they are kept confidential, secure, used properly and not disclosed to unauthorised people.
18. You must immediately inform us if there is any reason to believe that a user ID or password has or is likely to become known to someone not authorised to use it or is being or likely to be used in an unauthorised way.
19. You must immediately inform us of any changes to the information you have supplied when registering for the service.
Trial Data Collection
20. The results of the trial will not be made public and you will have no right to any such results.
21. You agree that copyright in any information or designs arising as a result of the trial will belong to us.
Confidential Information
22. You agree to keep in confidence any information (whether written or oral) of a confidential nature obtained under this agreement and will not disclose that information to anyone other than those we agree without our consent.
23. You will immediately notify us if you become aware that the information referred to in paragraph {22} has been disclosed and that information may be put to unauthorised use.
Our responsibility to you
24. We accept responsibility if you are injured or die as a result of our negligence. We will not limit this responsibility.
25. We also accept responsibility for loss or damage to your physical property arising from our negligence. We will pay up to £1 million in any 12-month period for this loss or damage.
26. Unfortunately we cannot guarantee the service will never be faulty. We have no obligation to compensate you for financial loss, for data being lost or corrupted, or for any loss that could not have been reasonably foreseen (expected) in light of paragraph 2.
27. Unless paragraphs 24 and 25 apply, we will not pay you more than £5,000 in compensation (even if we have been negligent).
Matters beyond our reasonable control
28. Sometimes we may be unable to do what we have agreed because of something beyond our reasonable control. In these cases, we do not accept responsibility for what has happened.
If you break this agreement
29. Other than for serious misuse described in paragraph 13, we will normally give you an opportunity to put matters right within a reasonable time if you break this agreement.
30. However, if you do not do so, we may suspend the service or end the agreement. We may also suspend the service or end the agreement if you break any other agreement you have with us and do not put matters right within a reasonable time. If we suspend the service, we will tell you what needs to be done before we reinstate it.
After the Trial
31. You agree that we may not continue to provide the service after the trial has ended.
Other things we need to tell you
33. We may take instructions from a person who we think, with good reason, is acting with your permission.
34. When we need to contact you, we will email you via your avatar. If you need to contact us, please use the address or contact we provide.
35. Your agreement with us is governed by English law and subject to the jurisdiction of the English courts. The dispute resolution procedures are covered in the Code of Practice on BT.com.
Service Schedule
What we provide
a) Calls
BT AvaTalk is a trial service that allows you as a user of the virtual world Second Life to connect a maximum of 10 free calls between your chosen phone line and another phone. You can start a call by using your avatar from BT AvaTalk Phone Box at locations within Second Life or by Head Up Displays that can be obtained from a BT AvaTalk Phone Box. Calls can be connected to most mobile and land line phones in locations around the world. Calls may last for a maximum of 1 hour. Once the 1 hour limit is reached the call will be terminated. Once one call is terminated you can start another call immediately but once you have made 10 calls with your avatar you will not be able to make any more calls using the service.
Both people on the call will receive an incoming call.
Your call line identification will be withheld from the recipient of your call.
You will not be able to make calls to Premium rate numbers, 070, 09 numbers and some other number ranges.
You will not be able to use the service to make 999/911/112 emergency calls. If possible, you should make alternative arrangements and keep a main phone line available.
b) Texts (SMS)
You will be able to use your avatar to send a maximum of 10 free SMS to mobiles around the world. SMS can be sent from both BT AvaTalk Phone Boxes and BT AvaTalk Head Up Displays.
Each SMS is limited to 160 characters. This limit does not include the characters automatically included in the SMS detailing the avatar name that sent the SMS. There is no restriction on when an avatar can send an SMS but once you have sent 10 SMS using your avatar you will not be able to send any more SMS using the service.
Things that you should know about BT AvaTalk.
The trial service is available between 25th March 2008 and 24th April 2008 unless we end the service earlier. The trial service will finish on 24th April regardless of when you begin to use the service.
You will not be able to access the service or request the connection of calls to or send texts to certain worldwide locations that are not supported by this service. You will find a list of these locations on the website http://www.btavatalk.com/faq.htm#04. The list of blocked numbers can be updated without giving notice, where such numbers allow customers to exploit arbitrage opportunities in our pricing.
If at any time during the trial you reach the usage limits (10 Calls and 10 SMS) the service will no longer be available to the avatar that you are currently logged into second life with.
This service is only compatible with the virtual world Second Life and is not available on any other virtual world platforms. The service is only available from the Second Life client and is not accessible from your default web browser. You may only connect free calls between your own phone and another phone in a location supported by the trial.
